Legal Question in Family Law in Maine

dependant tax question

i have been divorced for 11 years and have been alternating with my ex wife every other year for claiming my son. i have a signed divorce agreement that states that we alternate until he is no longer a dependant. my issuse is that it is my year to claim him and his mother refused to sign off on the 8332 form that is required when i file my taxes. can i file them without the form? what will happen if i do? is a copy of the divorce agreement an accepted substitute?

Re: dependant tax question

Unfortunately, your question is really a tax question that should be answered by an accountant. Legally you can file a Motion with the Court to Enforce the existing Judgment and seek Contempt for her failure to comply, but that legal avenue is time consuming and expensive and is a last resort.
