Legal Question in Family Law in Maine

My husband has hired the same lawyer that handled our bankruptcy case 4 yrs ago to reperesent him in the divorce. Is that legal or fair? It would seem that this lawyer would have unfair background information to use against me.

There are very specific Bar rules for ethics of lawyers, and conflict in representation is one of them. Although it is possible for some conflicts to be waived, if you are uncomfortable with this lawyer you should send him/her a written notice of your ethics concerns immediately and request that he/she withdraw. There is also a lawyer ethics panel connected with the Maine Bar Association that you could contact if the lawyer does not correct the situation.
