Legal Question in Family Law in Maine

divorce??

September of last year my Ford Explorer was ''taken'' from me from my sort of ex-husband. We have never offically got divcorced becase I have no idea where he is and how no idea for the past 4 years. The vechile was in his name and I have ''owned'' the vechile i.e. made all payments, insurance, registration, repairs, etc. The local police from a small island MADE me release the vechile to him. My question is: is there a way I can get at least half of my money back for this vechile that I paid for. Again, we are not divcorced because I can't find him. Is there a way I can get divorced without him? He has now offically taken everything from me. I jst don't understand how they can make me release a vechile to someone who has no license, past drg history and obviously knowing that I have had the vechile since the day we purchased it. Again, I am not trying to get the vechile back, I want to get some of the money back for the vechile I paid for. Thank you.

The marriage and the car situation took place in Maine. I currently reside in Arizona. I am willing to travel if neccessary.

Re: divorce??

Have you lived in Arizona for 90 days? If yes, you can file for divorce in Arizona. You can file on your own, hire an attorney, or you may qualify for Legal Aid services where they give you the tools to file on your own. Note, that if you have children, the time period is different; the children must have been in Arizona for at least 6 months. Has your husband ever lived in Arizona? You mentioned he moves around a lot, does he have family or someone that may know how to find him?

The Maricopa County Self Service Center has good directions and forms. If you dont live in Maricopa, just change the name of the county to one where you are filing in Superior Court and most courts in Arizona should accept these forms. Go to http://supreme.state.az.us/selfserv/ and click to the Self Help Center, then Forms, then choose Family Court. Follow the directions for getting him served with a copy of the summons and petition. It should be possible to get a divorce, even if you dont know exactly where he is living.

As part of the divorce you can request the return of the truck or that you be reimbursed for the payments on the truck that you made. Be sure to detail how and why you want this money. Unfortunately, collecting the money may be more of a problem; youll have to collect against him somehow.

Good Luck
