Legal Question in Family Law in Maine
I have been divorced since 2008. Originally, my ex and I had shared custody of our son. She had him 3 days and I had him 4 days. He did not like being with her at her home and fought alot with her. 7 months after our divorce she gave up on him and he lived with me full time. no official court action was taken. since then she has only seen him about 10 days a year, each year. Our son is now 14 years old. he is doing well in school and is happy living with me. We would like to move from Maine to Massachusetts to be closer to my family. My exwife is not cooperating well in this process. do I have a good case if we need to go to court over this. She does not pay child support either.

Just to be closer to your family likely will not be a good enough reason. Also, it could be dependent upon how far you plan to move. For example, if you live in Kittery now and are moving to Haverhill, MA, such likely would not be a problem. However, if you are moving from Portland, ME to Nantucket, such provides a much tougher case for you. If she contests it, it likely will be a difficult case and depend upon many factors which you should discuss with a qualified attorney.
