Legal Question in Family Law in Maine
my husband is stationed in north carolina, I am in Maine. we want a divorce, he says if he files first, I have to go to north carolina. I can't do that, I have 2 children at home. Do I have to move my kids?

At one time I was also stationed in North Carolina and was assigned to the Fort Bragg JAG office. I believe what he means is that if he files for divorce in North Carolina, the divorce proceedings will occur in North Carolina. Depending upon how long you have lived in Maine, you could file there.
I would have to discuss with you other aspects of the case to assess whether or not there is a risk of you having to move the kids, but generally this would not be likely, even more so, if he is stationed at Bragg or Lejune. Also important is long how he has been in the Armed Forces, how long you have been married, why you moved to Maine, and where you were married.
