Illegal use of name and info

My ex and I divorced in 1996.Just recieved a bill from collector where she is currently using my name and personal info.What are my options?

Assuming your name is on the debt and that it was incurred during marriage, the divorce judgment may have allocated the debt solely to her and required that she refinance it into her name alone. If she didn�t refinance, you could bring a contempt motion against her and seek injunctive relief; or, to better protect your credit, you could pay off the debt and bring the contempt motion seeking her paying you back with attorneys fees, though legal fee recovery is never guaranteed.

If she incurred the debt after the divorce judgment, you could still pay off the debt to protect your credit, then sue her for payment and further damages under claims of tortuous interference, invasion of privacy or similar actions. You could call the District Attorney�s office to report her activity that is apparently fraudulent.

You could write the creditor and demand copies of the underlying paperwork. We would have to review the debt documents together with the divorce judgment to better discuss your options.
