Lving together, breakup and custody

My 12 year relationship is over. We have a 10 year old son. Does custody law apply even when there is no marriage? I would like to have joint custody but have the primary residence for school.

The short answer to your question is yes. Whether or not you were ever married, you have parental rights & responsibilities with respect to your natural (or adopted) child. If you cannot reach an agreement with your former partner, an action may be filed in the appropriate district court to establish primary residence, visitation, child and the rights and responsibilities of the parents.
