Obtaining Passports for children of divorced parents.

Application for passports for minor children require both parents to appear or a notarized statement of consent from non appearing parent. Is there legal action that can be taken if one parent refuses to appear or sign a statement?

Probably, although as you've no doubt surmised, that would be the unusual case. I think it would depend on the circumstances of the traveling. Generally speaking, if the travel were in the children's best interests, it would seem to me that the non-consenting parent would have to come up with a good reason why he or she will not sign.
