Question about shared custody and relocating

I have shared custody with my ex boyfriend. Our son is 1 and 1/2. I wish to relocate IN STATE, about an hour away and I''m wondering because my son is so young, can I get shared custody changed? I don't approve of the way the fathers' girlfriend is raising my child. He spends the majority of the time with her and not his father. What can I do?

The answer to your question depends on several facts: how long ago was the parental rights and responsibilities order entered? Would your ex boyfriend object to the change in residence? Is it feasible to meet halfway (1/2 hour drive each way) to continue shared residence?

The process to change the residence, in the event the ex boyfriend does not consent, is to petition the court to modify the existing judgment to provide you with primary residence. Bear in mind that there must be substantial and real reasons why the residency should be changed. Disagreeing with the girlfriend's parenting might not be sufficient, although the ex boyfriend's insufficient time with the child might be.
