Legal Question in Family Law in Maine
Temporary custody of minor child
The finale hearing of my divorce my abusive husband was granted temporary custody of our child because I live in a 30 foot trailer until my house is finished. The minor child is to reside with him until June 10 then come home, sense she has been with him two months he has not let me have contact with her or see her she is failing in school which I have talked with her teachers and she will have to make that up during summer school, and she has missed nine days. I have filed with the court a contempt order and have a court apt. on the 9 for that. Can the courts overturn this decision and let her come home at the contempt hearing or does that order stand and she comes home in June?

Re: Temporary custody of minor child
Although I do not know what the exact language of your Parental Rights and Responsibilities Judgment is, it is very likely that the Court may, through its general contempt powers, be able to amend the judgment to provide that your daughter return home on an expedited basis.
It is important for you to be very clear to the Judge the remedy you are seeking. I wish you the best of luck.
