Legal Question in Medical Leave in Maine

paperwork?

My husband works in a local factory and they have recently put a new attendence policy into place, which will be seriously affected when he takes time off to spend with his family when our baby is born. The attendence committee is telling him that there is a federal form that he must submit to the company prior to taking family medical leave when our child is born in August. The company, however, can produce no such form. Is there really a form out there, or are they sending us on a wild goose chase?

The company has the responsibility to provide the form (WH 380) available from the US Department of Labor. The company is prohiibted from counting the FMLA leave against your husband in thier attendance policy. I suggest that whtever you do, communiciate in writing with the company, and again advise them of the circumstances and anticpated dates of leave
