Legal Question in Civil Litigation in Maine
Attorney Misrepresentation
If an attorney stated we had a solid case. Charged some hourly fees then changed our chances of winning the case as we approached mediation. Nothing new developed in the case. Is this ethical, and/or illegal? We paid for representation at mediation and we did all of the negotiating and arguing. Should we have to pay? He was supposed to handle all the discussions. Thank you.

Re: Attorney Misrepresentation
Based upon the information that you have provided, it is difficult for me to give an opinion on those issues. Evaluation of ethical and legal issues is complex. I suggest that you talk to the attorney about your concerns, clearly explaining your dissatisfaction and the reasons for it, while telling him that you do not feel that his charges are entirely justified. Hopefully, the attorney will work with you and reach a good resolution. Good luck. Thank you for your inquiry.
