The Will should be on file with the Registry of Probate in your County. At the very least an estate should have been started by someone to obtain the authority to attend to the affairs of the deceased.
A lawsuit can seek pain and suffering and emotional distress as damages, depending on what the actual misconduct is alledged to be. If your siblings were granted authority by the Probate Court, I am not sure that the process of internment that they choose is grounds for a civil action by you, but it may be if more facts are known.
