Legal Question in Civil Litigation in Maine
parking lots
I work in a small shopping mall which we all share the same parking lot. Today I left work and hit a huge dip, I heard it but thought nothing of it until I stopped at the corner store and someone I know came in and asked 'Who hit me'' I had no idea what they were talking about until I went out and looked and saw that my left front end was cracked all the way from the bottom to the top of my headlight. My car had been parked for 4 hours and I only drove it to the store hitting NOTHING. You can tell that no other car hit me .
Can I sue the owner of the lot to pay for my damages?

Re: parking lots
The short answer is: "It depends..." It depends on the size of the dip, whether warning signs existed, whether it is considered a defect, how fast you were going, the condition of your car's suspension, etc. These are very difficult cases to bring to trial and win. The parking lot owner's insurance company will likely fight it all the way. If your damages are less than $4,500, you can bring a claim in small claims court (at your local state District Court), without having to hire an attorney. Unfortunately, it is not a case that I would accept. Sorry that this happened to you. Thank you for your inquiry. Good luck!
