Legal Question in Civil Litigation in Maine

Road Association Dues

I belong to a road association in the area I live. In the begining we all agreed to pay a set fee twice a year towards the road and its up keep. Currently there are several members who do not or have not paid lately. We were wondering if there was a standard form we could use or formate to follow to place leins on this property to get the owners to pay there fair share?

Re: Road Association Dues

There is no form to be used. The language of the road agreement will be very important in determining how and when collection efforts can be brought, and if the debtors may be forced to pay for the legal fees incurred in the collection. You may have a small claims case, and you may also be able to file a lien if the agreement provides for it. Ultimately, it may be best to have an attorney do the work so that it is not perceived by the neighbors as "personal", but just business of the neighborhood.
