Re: workplace harrassment

We received your earlier inquiry regarding workplace harrassment. Although Maine is an "employment at will" jurisdiction (meaning that employment can typically be terminated for any reason or for no reason) there are exceptions to this rule: For example, an employee's position cannot be terminated for discriminatory reasons. Is the employer's harrassment discriminatory in nature? Regardless, the employer should not be harrassing you: That is illegal and you have every right to protect yourself against further harrassment/threats. Feel free to contact me to further discuss, as it is important that any attorney handling this matter receive more information as to the specific facts at issue before rendering legal advice.

Yes, you do have rights. If the harassment is based on your sex, race, religion, sexual orientation or other factors, you may have a claim that you can bring under the Maine Human Rights Act. You also may have a claim under Federal employment laws, and you may be able to take specific action regarding the threats of physical harm. You should set up a consultation with an attorney to discuss the specifics of your case.
