Legal Question in Immigration Law in Maine
H1B1 visa and owning a home in USA
We are Canadian. My husband has a H1B1 work visa to work in Maine. He bought a house in Maine. We are thinking about moving back to Alberta, Canada. If we move what about selling the house? Can he go to Alberta to live and work and our children and me stay here until the house sells? Are we expected to leave with him and trust someone else to sell the house? My children and I are not allowed to work here in Maine. We are here under my husbands work visa.

To remain in the country on your H-4 visas your husband does have to be gainfully employed under his H-1. An alternative may be to transfer you and the children to visitors visas until the house is sold. On the same token if you are Canadian citizens you may be able to come to the US to close our your house sale without concern. Just speak to an attorney to make sure things go smoothly. I don't expect that it should be too difficult if the facts are as I see them.
