I am from the U.S. and I met someone that is on the H-2B and he is in NH right now working. I just needed to know how we can get married and not get in trouble. He has to leave in Nov. and we plan to marry in Oct. his visa ends june of 2009. If we marry before he leaves on work leave in FL can he stay after we married or does he have to still go to FL until May and then come back. I am new to this and I would like some guidence please. I am in maine and I need an immigration lawyer out here to help us.

Yes, assuming you are a U.S. citizen, marriage and applying for the adjustment of status will allow your spouse to remain in the U.S. while the application is processing.

If you are a US citizen and he is in valid H-2B status, then you can get married and file the permanent resident application for him.

If your fiance is now in legal status, and you both marry, you can file petition and applications to adjust his status to lawful permanent resident. There is no reason you cannot get married -- this is the United States of America -- we allow that sort of thing, okay! Joking aside, I suggest you try to find a good immigration lawyer.
