Legal Question in Immigration Law in Maine
My son, a US citizen got married to a woman in Mexico who is a Mexican citizen. They are now in the US, and beginning the process to file for her residency and green card. Once they file they were told she gets a work visa- to be able to work now? Can she volunteer before that work visa comes? Can she travel our of the USA while in the process of filing and awaiting green card? She is in the US on a travel visa which expires on July 19, 2011. She was told she would be issued a special travel visa while awaiting the green card.

She should be issued an advance parole document while the green card petition is pending which allows her to travel. It can take 3 months to get the advance parole document. She can volunteer before she gets her EAD card.
