As a Franchise Attorney I can say this. Copyright does not protect names; that's the function of trademark law. Trademark rights can arise by common law usage without filing anything. So it's important not to infringe on trademark rights held by others. Consult with a good intellectual property or franchise attorney in your area for specific advice.
