Legal Question in Medical Malpractice in Maine

I know there is no standard for medical malpractice . I had surgery and it went wrong. A second surgery and I am still a year later in pain from what went wrong. Is there a dollar amount average for Pain caused by a doctor miss up.

There is a standard for medical malpractice. In order to determine whether a doctor committed malpractice, and before I would move forward with a case, the first thing to do is hire an expert/doctor to review all of your medical records and render an opinion about malpractice. If that opinion is favorable, then we look at whether you want to proceed. It is helpful to have a general understanding of the extent of your past and future damages. If the case is not worth close to $100,000 or more, then it is not worth going through the medical malpractice process. The time and expense associated with the process typically requires that you meet this value/amount, because you actually have to go through 2 separate trials he for you have the potential of seeing any compensation. There is no dollar amount average for pain, as damages/dollars are determined by the specific facts of the case.
