Legal Question in Medical Malpractice in Maine

My son was born 15 wks premature in July 2006, at 3 days old he started having complications at night, the Nicu doctor was called 3 times and would not do anything. My son ended up going for emergency surgery for internal bleeding, at which point it had been going on for 12 hrs. The doctor did not follow hospital protocal. My son has muscle damage from bleeding internally for so long, even 3yrs later. My question is could the hospital still be sued after all this time?

I am sorry that your son has health issues. It is now almost 4 years since the date of the alleged medical negligence. Maine has a 3 year period (the statute of limitations) for bringing a claim in court. You have missed that deadline, and are likely forever prohibited from bringing a claim against the doctor or the hospital. The licensing board for doctors is in the Department of Professional and Financial Regulation in Augusta, as they are part of Maine State government. You may still file a grievance there, but they do not have any authority to order that your son be compensated.if your son has not yet seen a specialist regarding his muscle damage, you should follow up to see if there's anything that can be done to help them.
