Legal Question in Personal Injury in Maine

On February 4, 2010, I was rear ended while at a complete stop in traffic traveling east on Interstate 95 in Connecticut. The car was totaled and there were injuries. The driver of the other vehicle cancelled his insurance the night before but we did have 300,000 uninsured motorist coverage. I suffered a destroyed knee and had to have a knee replacement which causes me pain everyday with every waking moment, among other related injuries. This was not covered under any workmans comp policy. At the time the vehicle was worth approximately $16,000. Allstate insurance Company refuses to give me a penny over 6000. My company had full coverage and the car was in immaculate condition. The law firm of Robert H D'Auria, of Bedford MA. was hired to recover proper monies due. There were several phone calls back and forth, Allstate attempting to claim the car value was that of a stripped-down vehicle when the facts are this car had every available option. They are also claiming the car had a previous salvage title, the title our company possessed is clean with no mention of salvage anywhere. We paid full price for the policy and signed a fully insured policy, not a scaled-down version of lesser value that offered lesser coverage. This law firm wrote one letter and made a few calls after having the case for over eight months. After numerous phone calls and e-mails regarding the status or any progression whatsoever in this collections matter, none have been returned and I am at a standstill. We are seeking someone to pick up the ball and roll with it immediately. The vehicle was a 2005 Toyota Prius with less than 20,000 miles insured by our company in Maine. Please call or e-mail if your firm can offer any assistance with our loss. 877 779-7122 Paul Marino.

Mr. Marino, I tried to call the number you provided but could not connect, even to leave a message. I would like to know if you are looking for assistance with the injury claim as well as the vehicle damage? I am happy to speak with you to see if I can help, and with respect to the vehicle would need to see the documentation and written responses the insurer has provided to date to support their position as the offer seems from your account to be extremely low and it is unusual in my experience for vehicle damage claims to be this difficult to resolve.

If you would like to email me, so I can call or email you directly, I am at [email protected], and my firm website is www.atrlaw.pro. Thanks.- Jerome
