Generally speaking, if an injury took place in the State of Maine, you would file a suit in Maine, as Maine law would apply. You should consult an attorney with the specifics of your case to make sure.

You may choose to keep a local attorney in NY to guide you, but the case will need to be brought before a Maine medical malpractice screening panel, and possibly into Maine Courtroom. It is a personal choice if you want to locate a Maine attorney yourself or if you want to have a NY attorney serve as co-counsel.

I am sorry that you were injured during your time in Maine. I am from New York State originally, but I have been practicing law here in Maine for 22 years. If you were injured in Maine, then the Maine courts have authority over the case...known as jurisdiction. Consequently, if suit is brought, it is helpful to have a Maine attorney who is familiar with the Court rules and with Maine law. I represent many people from out of state who are injured in Maine. We can do a lot by phone, mail, and email during the process of trying to resolve the matter by settlement before suit is filed. The misdiagnosis claim would be included in the original claim for injuries under Maine law, so it would only be one claim.
