Legal Question in Personal Injury in Maine

rear ended 11 11 2007

my husband and I were in a rear end accident. the other driver was at fault. he was looking for his cell phone becasue it was ringing and ended up rear ending us going 45 to 50 we were going 20.

the speed limit was 25. we were slowing down for stopped traffic.

i went to the hospital in an ambulance. i have been put on two diffrent meds. one anti depression one anxiety to help loosen muscels. i have suffred anxiety panic for 10 years. husband lost one week of work.

was this driver neglagent? how would our settelment work?

Your question is so broad that it cannot be properly answered in this format. Do you have insurance? what are the limits of your coverage, including "UM/UIM" coverage? how much do you have for "medical payments" coverage? do you have regular health insurance? Who is the insurer for the other driver? Have you spoken with that adjustor yet? What were your injuries? Have you followed up since the ER visit with another doctor?

Liability seems clear enough from your description, but the issue of how much the case is worth, and the possible timing of a settlement need to be carefully evaluated.
