Do you have insurance? what are the limits of your coverage, including "UM/UIM" coverage? how much do you have for "medical payments" coverage? do you have regular health insurance? Who is the insurer for the other driver? Have you spoken with that adjustor yet? What were your injuries? Have you followed up since the ER visit with another doctor?

Liability seems clear enough from your description, but the issue of how much the case is worth, and the possible timing of a settlement need to be carefully evaluated.
