Legal Question in Personal Injury in Maine

How much to settle for?

I have had a radial head replacement and been declared permanently injured. Workers Comp wants to settle soon how much should I ask for? I already have proof of another surgery within the next 5 years as well. I just don't know where to start or what figure to start with?

Re: How much to settle for?

Thank you for your inquiry. It sounds like you have been through a lot. Your question does not present enough information for me to answer it without making wild assumptions and big guestimations. I would need to know more about your injury, the rehabilitation period, the cost of surgery and other care, the type of work and amount of compensation, as well as permanent impairment ratings. It is rather complicated, particularly in the workers compensation arena. When the Comp people are rushing to settle, you should ask yourself "why?", as I would be suspicious. They are hoping that you don't speak to an attorney, because they understand the benefit that you would have by hiring an attorney. We can typically negotiate a much higher settlement...one that nets more money for you, while earning our fees. Please call or email if you want to discuss this further. Thank you.
