You must check your local ordinance to determine this answer. In many municipalities you can put the fence right up to the line so long as the height of the fence is 6 feet or lower. However, if you do not leave sufficient room between your fence and the property line, you will need to consider how to obtain future access to the other side for maintenance of the fence. Perhaps obtain an easement from your neighbor which must be in writing and be recorded in the county Registry of Deeds to be enforceable against future owners.
