Conflict of Interest

Does a conflict of Interest exist If a law firm should represent party ''A'' in an action against party ''B'' who is also a customer of the same firm?

ie: A Real Estate action brought against a Broker who is and has been a customer of the same law firm. The firm has and does perform title work for the broker.

Any ethical concerns should be presented in writing to the lawyer in question, and a written response sould be insisted upon. Any ethical complaints should be directed to the Maine Board of Bar Overseers in Augusta, who will investigate the ethics allegations.

With that said, I am not sure if the broker is actually a client of the lawfirm based upon your description. The lawfirm would normally represent a buyer, seller, or lender and perfom title work for a Closing, but not represent the broker, even though the broker may benefit when the transaction closes.
