Legal Question in Real Estate Law in Maine
Fence between Homeowners
Hello: The fence between my single family dwelling and my neighbors' needs replacing. I understand that it is located on my property. Must I consult with my neighbor about replacement issues...height; style; type etc? Is my neighbor required to split the
cost of new fence? If not, how close must the fence be to the actual property boundary line before there is a shared financial responsibility for this fence? (The fence ''appears'' to be between our properties but another neighbor has told me that it is actually on my property.) Thank you!

Re: Fence between Homeowners
If the fence is really on your side of the boundary line you do not need to consult with your neighbor at all. It may be a friendly thing to do but it is not required- just be sure of the boundary line. Your neighbor is not responsible for any cost. As to the height and distance from the boundary, check with your local code enforcement officer about zoning- each town is a little different on those particulars.
