If there is an actual condemnation notice posted on the property and the landlord hasn�t taken steps to remedy the issues that led to the notice by the first of the month, then I think you have a very strong argument that the rent and security deposit should be returned. Maine landlord/tenant law focuses upon the concept of �habitability�: If the property is �habitable� (has heat, running water and is generally safe for occupation) then your obligations under the lease continue. I suggest that you contact the City to learn the origins of the condemnation notice (assuming, again, that one is posted). You should also contact the landlord to glean the landlord�s position on the situation and what the landlord intends to do to fix this.
