Sounds like misrepresentation, but could be a sloppy mistake. However, if the contract is correct as to the actual lot size before it is signed, and/or the contract is not signed because of the discovery prior to signing that the lot size is much smaller that advertised, I do not see how there is much by way of measurable damages, and therefore a suit would not be adviseable
