Legal Question in Real Estate Law in Maine

Real Estate left to children

If the children of a father who died left his house to the children in his will (his wife was pre-deceased), and the children do not want the house and are willing to sign it over as a gift to one of the grandchildren, do the other grandchildren have a say in this transaction?

There are a few issues here. First is the exact language of the will, you want to make sure that it is being followed. The language of the will ultimately determines if the grandchildren have a say.

Then are the procedural and tax issues. The transferring of the deed will have tax consequences, so it will be important to consider the options before you transfer the deed.

I would recommend getting a lawyer to help with this.
