Legal Question in Real Estate Law in Maine
I want to sell
My ex-husband and I own a home together,it's a single home with an apartment next door. We both still live on the property, him in the house and me in the apart. I want to sell my half, but he wants to keep it. What can I do?

Re: I want to sell
Thank you for the question. My questions to you are: How is the property owned? Is it one lot that is owned in joint tenancy? Do you own it as tenants in common? Did the Divorce judgment address ownership and/or sale of the property?
If the property is owned in joint tenancy, you can give notice of your intent to sell, thus allowing for him to buy your interest at a market price. Otherwise a lawsuit known as an action for "partition" can be brought to obtain a ruling with respect to forcing a sale. The Town should be checked with to see if the property can be split and the home and apartment be sold seperately, or, as is often the case, zoning will not allow for the lot to be split.
