Legal Question in Real Estate Law in Maine

does she have a right to sell my truck

My farm truck was parked on my son's back lawn. When he got his divorce his wife got the house. She has had the house for about a year. I found out she sold my truck the other day. Does she have a right to do this? The truck was old but in good condition and hasn't been registered for about 5 years.

Re: does she have a right to sell my truck

Without a title, her buyer relied upon a Bill of Sale and she had apparent right to sell it. However, she did not get the right with the Deed to the house, and it is unknown if the property settlement was worded broadly to cover it.

Even if you have not ever given her the right to the truck, you did not have the right to leave it there without her permission once she took possession of the property. Did she give you any kind of notice of abandonment by you of it? Did you get a notice that you were being charged storage fees? A demand that you remove it? It is difficult to comment without knowing more of what transpired, but if there was no permission granted by her for you to leave the truck, there may not be much legal help available for you now.
