changing a will
Hope you can help me with this. My mother remarried several years ago. They made out wills together, with the agreement that it can never be changed without the other person's knowledge and consent. Here's the question....she feels the need to change who she stated as PR. She had stated her husband to be, with someone else stated should he not be alive. But now, has concerns about his capabilities to do this. They are both almost 80. She has no desire to change anything else about the will. To do this, does this require a making out a whole new will?? Any info or suggestions would be appreciated. THANKS!!

A whole new Will does not need to be created to make one change, instead a codicil can be drafted and signed. It will recite that the Will remains fully effective except for re-naming the PR. This is not particularly expensive in and of itself, but an atty assisting a client with this type of request would want to spend about an hour total and meet with the client to be sure that there was not some other issue impacted or that should be considered in conjunction with the codicil.
