Legal Question in Wills and Trusts in Maine

Estate inheritence without a will?

My Dad who has passed away, is included in an estate without a will. It includes only Nieces, nephews, and grand nieces and grandnephews. We've been told there is a formula for division of assets. Can you let me know what it is? Thanks, A grandniece.

Re: Estate inheritence without a will?

There is a "formula" under Maine law for the passing of an estate without a Will. It is known as intestacy. Generally, the estate is evenly divided amoung living heirs at the closest level of relation to the Decedent. I am unclear from your email what the family tree is, so it it difficult to be specific as to what share you may be entitled to, if any. You are entitled to obtain this information from the attorney, if there is one, who is handling the estate. You can also contact me privately to follow up as needed. Thanks-

Re: Estate inheritence without a will?

Your inquiry is a bit unclear, since, if there is no will, the assets would be distributed on an intestate basis, that is without a will. Also, it is not clear who the decedent is, and how you are related. Our office will happy to assist in sorting this out. Please feel free to call.
