Legal Question in Wills and Trusts in Maine
guardianship for minors
I am writing out my will myself with forms I purchased at my local probate court and would like to have my 15 year old decide on who she would like for a guardian rather then me picking one for her. Can I let her decide or do I have to list someone. Can I write under guardianship, my daughter to choose? and sign it?

Re: guardianship for minors
Your minor child will not be allowed to make the decision. The Court may take into consideration what a responsible teenager may have to say in favor of, or in opposition to, someone you name, and the Court would consider the teenager's proposed person as well. Not naming a specific person will lead to uncertainty later.
