Re: new hampshire resident property in maine for probate
If a resident of another State passes away, their estate would primarily be probated according to the laws of that State. However, if Maine real estate is owned by the decedent, then the Maine real estate must be probated by ancillary process in the State of Maine. The Maine ancillary process is commenced with the filing of certain documented authority from the primary Probate Court in the other state. Maine Probate Court approval is needed for the Personal Representative from another State to convey the Maine Real Estate.
An attorney admitted to practice in Maine is the best bet for this procedure to be accomplished smoothly. You should feel free to email me directly or call me at 207-767-4824 if you would like for my office to assist you, it is a process with which we are quite familiar.
