Legal Question in Wills and Trusts in Maine

legal guardians

my husband and I, would like my mother and her husband to be the legal guardians for our two children. My husband is an American Citizen, I am a legal resident.

We would like them to move into our house in Maine, to keep the changes our children would have to go through, as low as possible.

My mother and her husband live in the Netherlands and do not have a visa to stay here longer than 3 months.

Would this be possible and what would we have to do to get this worked out?

The Probate Court grants guardianships, both temporary and permanent. I am not aware of the Court granting either type unless the natural parents were in some manner unfit or unable to care for the children. Your message does not suggest that you and your husband are unable or unfit to parent. I do not know what effect, if any, a guardianship grant would have on the immgration services approval of a visa for your parents.

Nevertheless, I would be happy to consult with you and you husband further if you wish, and we can also engage an immigration attorney as well.
