My Fathers estate is in probate. Should I have a will stating that my husband retains my rights if I should die?

Your father's Will controls if you are a personal representative and pass away during probate who replaces you in that role.
If you are concerned about your rights as a beneficiary, then, yes, you should make sure your desires are in place should you pass away before your father's estate is settled.
