Legal Question in Wills and Trusts in Maine

Step Father wants to executor, but mother wished different

My mother named me as executor of her will, while she was living in New Mexico. She then moved to Maine. She was recently killed by a drunk driver and in taking care of all of the paperwork, her husband, or my stepfather has asked that he be made Personal Representative of her estate instead of me. All funds from life insurance, etc. were to go to her children and none to her husband. These have all been distributed, and nothing else remains to our knowledge, except whatever is left over from all insurances after hospital bills have been paid. But, we were told that according to the lawyers this won't amount to much, and it would all go to her husband anyway.

Am I making a mistake by agreeing to sign over my executorship?

Yes! Your mother wanted you to do so for a reason. Maybe she didn't trust her husband. Do it yourself and take care of your mother's estate as she asked you to.
