Legal Question in Wills and Trusts in Maine

No will

There was no will when my grandmother passed away. My step grandfather then passed away 18 months after. The deed to the house is in my grandmothers name only. They were marreid for 44 years. He wanted the house to go to a specific person. Who by law is entitled to the estate?

Re: No will

Her estate should have been probated as intestate. If she had living children at the time of her death then they would split 50% and your step-grandfather would retain the other 50%.

Therefore, the real estate is probably not really his to give to anyone at his death. Did he leave a Will? The matter will need to be probated for the real estate title to be cleared up.
