We have two sons. Have named the older son executor, and are concerned that a member ofhis family will be able to walk in and take what ever they want. The items are family heir-looms, that are to be equally shared. How do we prevent this?

If your Will generally leaves it up to the executor to distribute personal property equally, you will have to accept the fact that it will be under that person's control. On the other hand, it is often adviseable to create a "side list" of how you want personal property to be distributed. This list can be informal, handwritten, and changed by you as often as you wish. However, your Will needs to refer to such a side list to be incorporated. I suggest that clients do this as a standard practice.
