Legal Question in Disability Law in Maryland
My husband was fired after 27 years of service with an electrical company due to the fact he had a stroke in November, which left no residual impairments, and was released back to full duty. In April, he suffered an episode, the neuorologist is not sure how to categorize other than to say it was an effect from the stroke that caused a "misfire" and he became unconscious while driving a company vehicle. He has went thru numerous tests, procedures, etc., all have come back fine. He was released back to duty on 8/23/2010. When we went to his employer with his return to work forms from the doctor, etc., the employer told us "they culdn't take the chance of something happening again, and were letting him go." Wuld this not fall under the Disabilities Act Law, how culd they fire hm on a "what-if" notion. In that case, anyone wuld hav to be fired that had high blood pressure because they may hav a stroke or heart attack? He is only 50 years old, and we are now devastated over this financial loss. Do we hav any recourse?????
