Legal Question in Disability Law in Maryland
i work for u.s.p.s and f.m.l.a cert. since 1999 for knee problems and in 2004 became cert. f.m.l.a, a.d.a, rehab act for a chronic condition (diabetes, h.b.p,)(in 2010 updated with sleep apnea diagnosed in 2005-6) and( depression to present day for intermittent unscheduled leave. i have been suspended 3 times for attendance issues and was given a removal on 2-23-10 and put into a non-pay statue so after 31 days no benefits (U.E.I only) .in august i received a letter(u.s.p.s) that said I'm reactivated (not reinstated). removal canceled as of 2-23-10 this is in 8-2010. will be a 14-day time served. do i get back pay for failure to accommodate a qualified employee with a disability without trying any options other than not firing me for tardiness or calling in advanced for sickness( that is already approved) which can happen at any moment.
