Legal Question in Bankruptcy in Maryland
bankruptcy and recieving tax refund
I am currently filing bankruptcy and it should be final in the nexy month or so. I'm also suppose to get back a large return this year. Can the creditors basically stop me from recieving my return to pay them off?

Re: bankruptcy and recieving tax refund
Your tax refund is indeed an asset of the bankruptcy estate, and if you can't exempt it, it will be taken by the trustee for the benefit of your creditors. Make sure your bankruptcy lawyer is aware of this - you may want to delay filing to deal with this. (Don't even think of doing this without a lawyer).
