Legal Question in Bankruptcy in Maryland
Bankruptcy and Wage Garnishment
If I have filed Chapter 7 recently and received a case number, can a debtor such as a condo association garnish my wages after the bankruptcy has been filed?
Also, can the same condo association foreclose on the property as well as auction off the property and garnish my wages even through I have filed chapter 7 bankruptcy?

Re: Bankruptcy and Wage Garnishment
No (unless you filed one or more prior bankruptcy cases that were dismissed within the past year, such that there is no automatic stay or a shortened stay). But you do owe continuing condo fees starting after the bankruptcy filing. And if they have a lien, they can get relief from the automatic stay (or wait until after discharge) and then sell the property in saatisfaction of the lien. They cannot garnish your wages. Discuss this with your bankruptcy lawyer; if you do not have one, you should get one. I practice bankruptcy law in Maryland and would be pleased to assist you.
