Legal Question in Bankruptcy in Maryland
ch 13 bankruptcy
I filed ch 13 about a yr ago. I am worried about keeping up w/payments(agreement was to keep up w/mortgage and car payment-not included w/bankruptcy). If i default w/ch 13-does this count as being filed? I was thinking about filing ch 7 if it doesnt count as being filed.

I'm not sure what you mean by "count as being filed." If you can't keep up the payments, it may be possible to modify your plan. If that does not work, and you want to file Chapter 7, it may make more sense to convert your case, but you can let it be dismissed and re-file. Before you do anything, discuss the matter with your lawyer; if you don't have one, get one.
