Legal Question in Bankruptcy in Maryland
Chapter 13
My spouse filed Chapter 13 and it included a car that no longer runs-it had a lien on it by finance company-My husband is paying the Chapter 13 back with his wages garnished.Can we sell this car since it longer runs or will we have to wait until the 5 year plan is satisfied? Can we donate the car and write it off?

You may be able to amend the plan to surrender the car to the secured creditor, but it may not affect the plan payments unless unsecurerd creditors are getting 100%. Consult with your lawyer for specifics.
