How is an employment agreement addressed if my employer files ch 11 banruptcy protection. Can I recover anything?

Re: Employment agreement

in a chapter 11 situation, very likely there will be a plan proposed. Treatment of your employment contract will be explained in the plan. You will have a chance to vote or reject the plan. however, the employer in a chapter 11 will still be functioning as a business, so your employment may remain intact. I am not sure from your message, exactly what the nature of the employment agreement is, so I cant explain any better. If it is just a normal pay for work, then I cannot imagine it will be affected by the filing. If, however, employer has promised some kind of large bonus, which it now seeks to void, that might be possible in the bankruptcy.

Re: Employment agreement

It depends what you mean by "employment agreement". If it's just durational, pay for work, the company could get out of any future obligation to employ you. If you are owed back wages, they may be delayed but likely paid. If you are talking about future obligations, chances are the company can get out of them. If you have specific questions or concerns about a specific agreement and/or specific case, you should consult a lawyer. My contact information is below.
